10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EAGLE VIRTUAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Eagle Virtual and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your violation of any third-party rights

12. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination:

• Your right to access the Service will immediately cease
• We will delete your account data in accordance with our Privacy Policy
• Provisions that by their nature should survive termination will remain in effect

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Sarasota County, Florida, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
